A mother has been charged over the death of her unborn baby after a fight broke out with another woman.
Marshae Jones, 27, was shot in the stomach by Ebony Jemison, 23, while five months pregnant in December 2018.
However because Jones initiated the fight and continued to lash out at Jemison a jury in Birmingham, Alabama, decided that she should be indicted over the baby’s death.
Police found that she was at fault because she initiated the fight with Jemison who was acting in self defence in a row about the baby’s father.
Pleasant Grove Police Lieutenant Danny Reid said: ‘The investigation showed that the only true victim in this was the unborn baby.
‘It was the mother of the child who initiated and continued the fight which resulted in the death of her own unborn baby.’
Ebony Jemison, left, fired the shot but was not charged after Marshae Jones, right, lost her baby
Despite firing the shot, Jemison was cleared by a jury. Reid added: ‘When a five-month pregnant woman initiates a fight and attacks another person, I believe some responsibility lies with her as to any injury to her unborn child.
‘That child is dependent on its mother to try to keep it from harm, and she shouldn’t seek out unnecessary physical altercations.’
The shooting took place outside a Dollar General store on December 4 at around 12 noon. By the time police arrived Jones had already been taken to hospital and efforts to save the baby failed.
